Asbestos Claims

Over the years, asbestos has been used in a wide range of products in Australia and, as a result, many Australians have been exposed to asbestos. Some of these people will develop asbestos-related diseases including asbestosis, mesothelioma and lung cancer.

These diseases can be very aggressive. If you have been diagnosed with an asbestos-related illness, or have good reason to believe you have one, it’s very important that you seek legal advice as soon as possible. You may be entitled to compensation.

It doesn’t matter if the exposure happened years ago.

  • Or you have left the job.
  • Or it happened in another state.
  • Or if your employer has gone out of business.
  • Or if the exposure didn’t happen at work.
  • Or you were a heavy smoker.
  • Or even if you don’t know how the exposure occurred.

We can help

We have unique experience and knowledge in this area. We maintain an extensive database of information that includes details of the types of products manufactured with asbestos, as well as buildings and workplaces where asbestos was used. This means we can often identify the source of your exposure quickly, and start building a strong case for you.

Know your entitlements

Just being exposed to asbestos is not enough for a successful claim. Before you can claim compensation you must be diagnosed with an asbestos-related disease. The vast majority of people diagnosed with an asbestos-related disease in Australia have valuable rights to compensation.

Compensation may include amounts for; loss of income, medical expenses, pain and suffering and loss of enjoyment of life, commercial or voluntary care.

It is important that you get legal advice as early as possible as there are very defined time limits and also to protect your entitlement to pain and suffering compensation.

Benefits to Dependants

If your partner or a family member dies as a result of an asbestos related condition, a claim for compensation may be available to the estate and/or dependants of the deceased.

James Hardie Inquiry

Slater and Gordon acted pro bono for the ACTU, the union movement and the victims groups around Australia in the Commission of Inquiry, which exposed the conspiracy between James Hardie executives and advisers to cheat victims of Hardies asbestos from their legitimate compensation entitlements.

Following the Inquiry, Slater and Gordon acted for the ACTU in the negotiation of the historic agreement between the ACTU, NSW Government and James Hardie which ensures that compensation continues to be available for victims of Hardies asbestos.
